Sarah Kuehnel, a 2017-18 Super Lawyers’ Rising Star, has devoted her entire career to providing litigation and counseling services to management and employers. She represents companies in all areas of employment law, appearing before administrative agencies at the federal and state level. She successfully defends employers in trial and appellate courts, while also providing advice, counseling, and training to mitigate the risks of litigation. Self-described as tenacious and pragmatic, Sarah is excited to present to share her knowledge on employment law with ECC SHRM on May 15.

 

Put to the Test:  How Employers Can Minimize the Risks of Pre-Employment Testing

 

Pre-Employment tests, including physical ability tests (PATs), can be valuable tools in determining a candidate’s ability to perform essential job functions. However, such tests face increasing legal scrutiny under the Americans with Disabilities Act and for having disparate impact on protected classes. This program will focus on the parameters of employment tests and the legal issues that come with them. This program will address the importance of carefully validating such tests prior to implementation and reexamining existing pre-employment tests to ensure they do not increase the risk of legal scrutiny.

 

Top 10 Hiring Mistakes

 

The hiring process is routine, right? We all know, and stick to, the basics, right? In an ideal world, yes. But, we also all know practical realities get in our way. In the second half of our lunch-and-learn, we will talk about common mistakes in the hiring process, including:  background checks, misclassification, bad interview questions, drug testing, I-9, and job descriptions.
